Restorative justice and parenting coordination in family remediation cases

Abstract

Restorative justice and family remediation are alternative approaches that can be implemented to resolve conflicts within the family sphere. Family restorative justice focuses on the comprehensive repair of emotional, material, and social harm, fostering healing and the restoration of family relationships. On the other hand, family remediation seeks to adjust preexisting agreements affected by noncompliance or changing circumstances, prioritizing practical and functional solutions. Both methods incorporate values such as empathy, effective communication, and mutual respect, although they differ in objectives and methodology. Restorative justice promotes profound dynamics in its practices, addressing trauma and strengthening family bonds, while remediation aims for quick and binding agreements. In high-intensity conflicts, parenting coordination emerges as a complementary tool to structure plans prioritizing the well-being of children and adolescents, providing stability in fractured parental relationships. Mexico has incorporated restorative justice into its legislation, promoting multidisciplinary interventions that strengthen the prevention of future conflicts. These tools represent alternatives to the traditional judicial system, offering inclusive, flexible, and human solutions that contribute to the harmonization of family dynamics and the overall well-being of its members.
