Conciliation as an Alternative Dispute Resolution in family-related judicial processes in the State of Nuevo León, Mexico

There is a wide complexity when trying to resolve conflicts that originate in the family nucleus. This article has a qualitative approach, part of a non-experimental design, under a transversal documentary-bibliographic level. Its general objective is to analyze the challenges that the figure of conciliation has in family judicial processes in the state of Nuevo León, Mexico, also to evaluate what its impact and effectiveness has been at present, in addition to supporting what the factors that contribute to the aforementioned State achieving the effective use of the conciliation method in family matters. After the review of the literature and the documentary analysis, the current laws and statistics at the national level of the use of alternative justice in Mexico were known, in addition, the causes that reduce the use of conciliation in court were identified, as well as the role that plays by the litigants, the parties and the judicial system in the interaction and search for a consensual agreement. Based on this analysis, it was concluded that conciliation as a figure is immersed in the laws, however, its optimal use will depend on proposing effective processes when using it, it was also made clear that the responsibility will always fall on the search and encouragement of the parties, advised by their lawyers in the use and promotion of the culture of agreement, which generates social well-being for families.
