The following article, entitled: “Family mediation in the best interests of children: situation in Nuevo
Leon”, analyzed family mediation in Nuevo Leon State in relation with the best interests of children
from the juridical and theoretical perspective to identify working areas in practice. It was used the
transversal, descriptive and proposal qualitative approach, based on the study, analysis and critical
view of doctrine, juridical norms and jurisprudence and the bibliographic references were taken
from official data bases. It was found that the design established for family mediation has juridical
insufficiencies that restrict not only the protection of children´s fundamental rights, but also comediation
practice and child´s participation in process. In conclusion, it was found the necessity of introducing
good practice in family mediation process for the best interests of children.
